Rental conditions for rental bicycles

THE ELECTRIC BICYCLE AND ITS USE

1. By accepting the rented bicycle, the renter acknowledges that it, along with all accessories, is in a roadworthy, roadworthy, undamaged and clean condition.

2. The renter may only use the bicycle in a manner consistent with traffic regulations and in compliance with all applicable laws, in particular the road traffic regulations. They may not use it off-road or for any other intended purpose.

3. The bicycle may only be ridden by the renter.

4. The bicycle may not be used for testing purposes, in commercial traffic, for a trip abroad or for unlawful purposes without the written consent of the lessor.

5. The renter is obliged to lock the rental bike with the provided bicycle lock.

6. The landlord explicitly requests that guests wear a bicycle helmet.

II. OBLIGATIONS OF THE TENANT

1. The renter agrees to treat the bicycle with care and in accordance with the technical rules, and to park it only in a secure place and in a locked state.

2. The renter is obliged to inform the lessor of any defects that occur during the rental period upon return of the bicycle.

III. REPAIR

If a repair becomes necessary, the landlord will bear the costs, provided that the cause is neither due to damage to the bicycle caused by the tenant's negligence nor a breach of contractual obligations. The tenant is responsible for the latter circumstances.

IV. ACCIDENT/THEFT
The renter is obligated to notify the owner immediately if the bicycle is involved in an accident or stolen. In the event of an accident, the renter must submit a detailed written report to the owner, including a sketch. The accident report must include, in particular, the names and addresses of all persons involved and any witnesses, as well as the license plate numbers of any vehicles involved.

V. LIABILITY
1. The renter must return the bicycle in the same condition in which he received it.

2. The renter is liable for any damage to the bicycle caused by their negligence and for any breach of their contractual obligations. They must also reimburse any incidental costs incurred as a result of the damage.

3. If a third party compensates the landlord for the damages, the tenant is released from his obligation to pay compensation.

VI. LANDLORD'S LIABILITY DISCLAIMER
The landlord's strict liability is excluded. He is only liable for intent and gross negligence. For slight negligence, he is only liable for breaches of essential or typical contractual obligations. If the landlord is held liable by third parties due to a breach of this lease agreement, statutory provisions, or official regulations by the tenant, the tenant is obligated to fully indemnify the landlord and fulfill all related obligations of the landlord.

VII. RETURN OF THE BICYCLE
1. The renter must return the bicycle to the owner at the agreed location no later than the end of the agreed rental period, during the owner's business hours. Returns outside of business hours are at the renter's own risk.

2. An extension of the rental period requires the landlord's consent before the rental period expires.

3. If the bicycle is not returned on time, the renter is liable to the landlord for each
to pay the daily rental fee for the day started and, if necessary, to compensate for any additional damage.

4. The bicycle must be inspected for obvious defects upon return, and the findings must be recorded in the contract. The renter is obligated to report any defects that occur during the rental period.

VIII. FINAL
1. No other side agreements exist. Amendments and additions to this contract must be in writing. This also applies to this written form clause.

2. Should individual provisions of this contract be or become invalid, the validity of the remaining provisions shall not be affected.

Operating instructions
We assume that you are familiar with using a bicycle.

• Familiarize yourself with the handbrake's operation by carefully applying it. Note Please also note their altered effect in wet conditions (longer braking distance, after "dry braking" there may be a risk of locking up when the brake is fully applied).

• Please use the city e-bike only on suitable, level surfaces and not off-road. To avoid unnecessary damage to the bike, always be aware of the road surface here in the national park, which can be challenging due to roots and slate stones. Avoid such surfaces and reduce your speed.

• The coaster brake (if equipped) only achieves its full braking effect when the pedal cranks are parallel to the ground. The braking effect in lower gears (e.g., 1st gear) is significantly stronger than in higher gears (e.g., 3rd gear).

• Please do not use the coaster brake continuously during long downhill rides; allow it to cool down periodically. Otherwise, malfunctions and damage may result. Use the rim brakes more often and only engage the coaster brake for short periods of braking.

• Only shift gears while riding. Reduce pedaling force to ensure safe shifting. A loud grinding noise indicates excessive pedaling force!

• Ensure that the tires are inflated to the recommended pressure of 3.8 bar (as indicated on the tire sidewall). Exceeding or falling short of this pressure by more than 1 bar can damage the tires and rims.

• Note the minimum insertion depth of the seatpost and handlebar stem (7 cm each/marking!).

However, we would like to draw your attention to a few details regarding electric bicycles.
• Activate the electric assist by briefly tapping the display to turn it on.

• Switch off the electric assist in exactly the same way.

• Start riding with electric assistance in the lowest setting and only increase it after a certain familiarization period.
